India’s top tax body, the Central Board of Direct Taxes (CBDT), has launched an investigation targeting potential tax evasion and money laundering through cryptocurrency and other virtual digital assets (VDAs). Aimed at “high-risk” investors, this initiative marks a clear shift toward stricter regulatory scrutiny over the country’s burgeoning crypto market.

As digital assets continue to gain popularity among Indian investors, regulators are increasingly vigilant about how these assets may be used to conceal unreported income. The CBDT’s probe focuses on individuals and entities suspected of manipulating VDAs to bypass taxation, a concern intensified by India’s historically high tax rates on crypto profits.

Under current law, crypto gains are taxed at a flat 30%, with an additional 1% TDS applied to every transaction—policies that many within the industry cite as overly punitive and discouraging to domestic trading.

The CBDT’s action complements ongoing consultations with crypto stakeholders regarding a dedicated VDA regulation—covering aspects like TDS reform and loss offset provision. These efforts reinforce India’s evolving stance, moving away from outright restrictions toward robust, law-driven frameworks.
